Terms of Use
MJS Software, LLC (dba PTOffice). MJS Software users agree to be bound by the conditions set forth under MJS Software. All MJS Software users must agree to the Terms of Use before installing or accessing MJS Software and using any MJS Software related services. The agreement is made within the MJS Software organization and end user registration process, not here. It is provided here for your information only.
This is a legal agreement between you, the end user, (“you” or “your”), and MJS Software (“MJS Software”). By clicking on “Start Trial”, you agree that you have read and understand this Agreement and will be bound by its terms and conditions. If you do not agree with the terms and conditions of this Agreement, do not click on “Start Trial” and do not request access to, or use, this software.
MJS Software grants to you a personal, non-commercial, non-exclusive, non-transferable, non-sub licensable, license to use MJS Software, with which this Agreement is provided, including any product documentation and any modifications, error corrections, bug fixes, new releases or other updates (collectively, the “Software”) and the services and the network related thereto (collectively, the “Services”) that may be provided by MJS Software during the term of this Agreement.
Your use of the Software and the Services is subject to your compliance with all of the terms and conditions of this Agreement and the policies of MJS Software as posted on its website from time to time, including without limitation MJS Software’s Privacy Policy. The most recent version of these documents can be found here (Privacy Policy and Terms of Use). By installing and/or accessing the Software and the Services you acknowledge that you have read and agree to be bound by all such policies. MJS Software reserves the right to modify or discontinue your access to the Services, the distribution, posting or publishing of any content, or to change the Terms of Use or any MJS Software policies at any time with or without prior notice.
As a condition of your using the Software and the Services, you agree that you will not (a) use the Software or the Services to download, upload, post, publish, insert, attach, use, share with others or otherwise copy or distribute music, movies, images or other content for which you have not obtained all necessary rights from the owner or rightful licensor of such content; (b) modify content identifiers (such as the title or the name of the creator of that content) in order to disguise the origin or description of any content; (c) download, upload, post, publish, insert, attach, use, share with others or otherwise copy or distribute any content that is defamatory, harassing, obscene, invasive of another’s privacy, or is otherwise illegal; (d) harm minors in any way, including without limitation by sharing, posting, publishing or downloading child pornography; (e) upload, share with others or otherwise distribute any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (f) interfere with or disrupt the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies or regulations of networks connected to the Services; (g) export or re-export the Software except in compliance with the export control laws of the United States and other relevant jurisdictions; or (h) collect any information about MJS Software’s network or users of the Software or Services by monitoring, interdicting or intercepting any process of the Software or the Services.
You understand and agree that the Software is a non-refundable subscription based service that will auto-renew on the anniversary of the subscription date. No refunds are given for unused portions of the subscription. The User bears sole responsibility for cancelling a subscription in a timely manner as to not incur a subscription renewal.
You agree to defend, indemnify and hold harmless MJS Software from any violation by you of the terms of this Agreement.
MJS Software users are limited to 5GB of data stored on MJS Software servers. If your data stored on MJS Software’s servers exceeds this limit your oldest stored data may be automatically expired if deemed necessary. MJS Software reserves the right to change or modify these storage limits at any time.
In order to use the Services, you hereby grant permission for the Software to utilize the processor and bandwidth of your computer for the limited purposes of (i) facilitating the transfer of digital files and communication between the users of the Software and the Services and (ii) facilitating the transfer of digital files to servers for purposes of posting content on websites or blogs and (iii) pasting links to content in instant messages and RSS feeds.
The copyright, trade secrets and all other intellectual property rights in the Software, product documentation and Services (including any images, photographs, animations, video, audio, music and text incorporated in them) and all trademarks and trade names associated with them are owned by MJS Software or its suppliers and are protected by the copyright, trademark and other laws of the United States and other countries and by international treaty provisions. You may not use any of them except as expressly permitted in this Agreement. MJS Software retains all rights not expressly granted in this Agreement.
Portions of the Software may contain software licensed from third parties and you are subject to the terms and conditions of those third party license agreements. You agree to comply with all such terms and conditions. Additionally, purchases made through the PTOffice Store module or Fundraising module may include an option for the customer to provide a “tip” to PTOffice. You understand that this is a transaction between the customer and PTOffice and does not involve the Organization hosting the store or fundraiser. As such, you will not, in any form, broadcast, email, or otherwise notify en masse, prospective customers to provide or avoid or include or not include a tip upon checkout. You understand that all provided tips are non-refundable should the Organization choose the option for processing. Any violation of this requirement will result in the campaign or account being forced to use the “percentage” pricing for that campaign or account, account suspension and/or legal action.
MJS SOFTWARE PROVIDES THE SOFTWARE AND THE SERVICES “AS IS” AND “AS AVAILABLE.” YOU ASSUME ALL RISKS IN USING THE SOFTWARE AND THE SERVICES. MJS SOFTWARE IS NOT RESPONSIBLE FOR THE ACCURACY, INTEGRITY, QUALITY, INOFFENSIVENESS OR LEGALITY OF ANY CONTENT MADE AVAILABLE BY USERS OF THE SERVICES. MJS SOFTWARE HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS AND IMPLIED, WITH REGARD TO THE SOFTWARE AND THE SERVICES, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANT-ABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
MJS SOFTWARE DISCLAIMS ALL LIABILITY, EXPRESS AND IMPLIED, RELATED TO YOUR USE OF ITS SOFTWARE AND THE SERVICES. WITHOUT LIMITATION, YOU AGREE THAT MJS SOFTWARE SHALL NOT BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL OR OTHER INDIRECT DAMAGES, EVEN IF MJS SOFTWARE BECOMES AWARE OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE RECOURSE IN THE EVENT THAT YOU ARE NOT SATISFIED WITH THE SOFTWARE OR THE SERVICES OR IN THE EVENT THAT YOU SUFFER FINANCIAL OR OTHER INJURY OR DAMAGE IS TO CEASE USING THE SOFTWARE AND THE SERVICES. SOME STATES DO NOT ALLOW THE EXCLUSION OF ALL DAMAGES OR INDIRECT DAMAGES, AND IN SUCH EVENT, YOU AGREE THAT THE LIMIT OF MJS SOFTWARE’S LIABILITY SHALL BE ONE HUNDRED DOLLARS.
MJS Software reserves the right to market to any individuals who have agreed to the Terms of Use. Emails will not be sent to those users who have not agreed to such action. MJS Software follows a strict “CAN-SPAM” policy and all emails will be obvious in origin, intent, delivery and substance and will include “opt-out” instructions at all times which will remove the registered email address from future mailings for that school year.
In the event that we receive notice that your use of the Software or the Services (including without limitation, your distribution of content through any of the Services) infringes the intellectual property rights of a third party or if you send material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive or encourages conduct that would be considered a criminal offense or that could give rise to civil liability or that otherwise violates any law, regulation, the terms of this Agreement or any of our policies, we reserve the right to terminate your use of the Software and the Services and to remove any files sent by you that are stored on our servers, with or without notice. We also reserve the right to decide whether content sent by you is appropriate and complies with this End User License Agreement. Upon any such termination, you will then cease any and all use of the Software and Services and will remove the Software from all hard drives, networks, and other storage media and destroy all originals and copies of the Software in your possession or under your control.

Kaiser Woodland Parent Faculty Organization (KWPFO) is committed to protecting your privacy. This Privacy Policy describes how KWPFO collects, uses, and shares your information when you use and interact with our Services and applies to all persons who use our Services (“Users”). If you have questions about KWPFO’s Privacy Policy or practices, or if you need to contact us about the information we collect about you, our contact information is at the end of this Privacy Policy.
This Privacy Policy applies only to the Services, and KWPFO’s collection, use, disclosure, and protection of your data. It does not apply to third party websites, applications, or services.

The Services are not directed to children under the age of 16. You may not use the Services if you are under the age of 16.
KWPFO collects data about you and your use of the Services through various means, including when you provide information to us such as when you join, opt-in for email communications, sign up for a membership, donate, register for events, and when we automatically collect information about you when you access, use, or interact with the Services. We use this information for a variety of different reasons, including to improve the Services and to tailor the Services to you.
The types of information KWPFO may collect about you include:
KWPFO Membership & Event Information: KWPFO collects certain Personal Data from you when you join KWPFO or register for KWPFO events. “Personal Data” refers to information about you that may be used to identify you, such as your first name, last name, email address, phone number, mailing address or information applicable to your student(s) enrolled at Kaiser or Woodland Elementary School. KWPFO uses this information to provide your membership, register you for events, provide information about memberships and events, and to deliver goods and services purchased to your enrolled student(s).
Payment Transaction Information: We may collect and store information related to purchases and donations made through the Services. You may provide certain information to complete payments via the Services, including your credit or debit card number, card expiration date, CVV code, and billing address (collectively, “Payment Information“), along with your name and billing, delivery and shipping address, to complete payment transactions through certain Services.
Please note KWPFO works with third-party service providers to handle payment transactions. KWPFO does not itself collect or maintain your credit card or other financial account information. You are subject to the Privacy Policies and Terms and Conditions of those service providers when purchasing a membership or KWPFO products, registering for events or making donations, the terms of which may differ from those of KWPFO. Please review the Service Providers’ Privacy Policies and Terms and Conditions before using their services.
Form Information: We may use online forms to request certain information from you in order to perform certain Services, such as your grade or classroom to assist us in fulfilling requests. This information may include Personal Data.
Correspondence Information: If you sign up for a membership, attend an event, email us, subscribe to our newsletters mailing lists, we may keep your message, email address, and contact information to respond to your requests, provide the requested products or Services, and to provide notifications or other correspondences to you. If you do not want to receive email from us in the future, you may let us know by sending us an email or by writing to us at the address below. Please note requests to remove your email address from our lists may take some time to fulfill as KWPFO is a fully volunteer organization. We may also still contact you as needed to provide important announcements or notifications regarding the Services.
Cookies, Web Beacons, Links, And Other Tracking Technologies: KWPFO may keep track of how you use and interact with the Services through the use of cookies, web beacons, links, and other tracking technologies including in the website platform used to maintain our website. Through these technologies we may automatically collect information about your use of the Services and other online activities, including third-party services, and client applications, and certain online activities after you leave the Services. Link information is generally only analyzed on an aggregate basis. Some Services may not function properly if you disable cookies. Such data may include analytics information, sites visited before visiting the Services, browser type, operating system, and tracking of your interactions with our content and emails.
Public Information: KWPFO may also collect information about you from publicly available sources. Information you make publicly available in any public or open forum, such as on a social network, may be considered public information for the purposes of this Privacy Policy, and may be accessed and collected by KWPFO. Please be aware that any content or information you share with or provide to third parties using or related to your use of the Services is neither private, nor confidential. KWPFO is not responsible for any content or information you post or share with third parties. If you do not wish for certain information to be public, please do not share it.
Users may opt-out of receiving certain communications from KWPFO by following the unsubscribe process described in an email communication, or by contacting us using the contact information provided below. However, please note the KWPFO does not control communications originating from Kaiser or Woodland Elementary School staff or Newport-Mesa Unified School District (NMUSD).
KWPFO takes reasonable efforts to secure and protect the privacy, accuracy, and reliability of your information and to protect it from loss, misuse, unauthorized access, disclosure, alteration and destruction. KWPFO implements security measures as we deem appropriate and consistent with industry standards. As no data security protocol is impenetrable, KWPFO cannot guarantee the security of the systems we have contracted, nor can we guarantee that personal information we collect about you will not be breached, intercepted, destroyed, accessed, or otherwise disclosed without authorization. Accordingly, any information you transfer to or from Services is provided at your own risk.
Please do your part to help us keep your information secure. You are responsible for maintaining the confidentiality of your password and KWPFO account and are fully responsible for all activities that occur under your password or KWPFO Account.
Website Hosting: KWPFO works with PTOffice as its web hosting services provider. PTOffice is located in Tucson, AZ. KWPFO shares your data, including Personal Data, with our website hosting Service Provider for the purposes of processing your data pursuant to your use of the Services.
KWPFO may modify this Privacy Policy from time to time and without notice to current or former enrolled school families. The most current version of this Privacy Policy will govern our use of your information and will be located at https://kwpfo.org/privacy.
